JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Ghanshyampur P.S. Case No. 131 of 2019, disclosing offences under Sections 409, 420 and 120(B) of the Indian Penal Code.

Petitioner is a Headmaster and allegation against him is of defalcation of Govt. fund to the tune of Rs. 9,49,210/-, which were to be deposited in the accounts of students towards scholarship and dress.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case without any investigation and the Audit report does not support the allegation.

Heard learned A.P.P. also.

No.61014 of 2019(2) dt.25-09-2019 2/2 Having heard both sides, in view of the allegation that the petitioner has withdrawn the amount, which were to be deposited in the account of the students towards scholarship and dress, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
