Heard both sides.
The petitioners apprehend their arrest in a case under sections 341, 323, 504/34 I.P.C. and section 3(i)(x) of S.C. and S.T. (Prevention of Atrocity) Act.
It is submitted that the petitioner nos.1 to 3 have already been arrested and as such, the bail petition on their behalf has become infructuous. Accordingly, the same is dismissed having become infructuous.
Learned counsel for petitioner no.4 submits that she is a lady and there is no specific allegation against her. Learned Special P.P. did not dispute the fact. Petitioner no.4 is a lady and there is no specific allegation against her.
Considering the facts aforesaid, petitioner Lalita Devi, in the event of her arrest/surrender before the court below within
Patna High Court Cr.Misc. No.40429 of 2014 (2) dt.25-03-2015 four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Dalsingsarai, Samastipur in connection with Ujiarpur P.S.Case No.70 of 2014, subject to condition laid down u/s 438(2) Cr.P.C.
