The petitioner seeks anticipatory bail in connection with Bettiah Town P.S. Case No. 91 of 2015 registered for the offences punishable under Sections 411 and 413 of the Indian Penal Code.
A Bolero vehicle is said to have been stolen pursuant to which the informant Vikash Rai instituted a case against unknown.
It is contended that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession.
Learned counsel for the State has opposed the prayer
Patna High Court Cr.Misc. No.42334 of 2015 (2) dt.09-10-2015 2/2 for bail. He has submitted that in course of investigation materials have been collected, which would show that the petitioner is involved in the offence.
Be that as it may, having regard to the nature of allegation, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the prayer for pre-arrest bail is rejected. (Ashwani Kumar Singh, J) Pradeep/- U T
