The petitioner seeks bail in Bariyarpur P.S. Case No. 125 of 2016 under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The informant intercepted one Maruti 800 and one Nano car bearing registration no. D.L. 2C L 1550 and B.R. 10 N 7706. The maruti 800 and Nano car were apprehended along with 120 litres of Indian made foreign liquor and two bags of Indian made foreign liquor which were kept beneath the back seat of the vehicle. The driver of the maruti car disclosed that the car is belonging to the petitioner. From the car huge quantity of Indian made foreign liquor was recovered.

It is submitted that that the petitioner has no concern

Patna High Court Cr.Misc. No.14814 of 2017 (2) dt.18-04-2017 2/2 with the car. The car does not stand in the name of the petitioner. The petitioner is not the owner of the vehicle. The driver of the vehicle was carrying the foreign liquor. The petitioner is in jail since 29.1.2017. Co-accused Amarjeet Kumar, who was apprehended on the spot, has already been enlarged on bail. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger in connection with Bariyarpur P.S. Case No. 125 of 2016, G.R. No. 2145 of 2016.
