ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.07.2019 in connection with Bathnaha P.S. Case No.159 of 2019 registered for the offence under Sections 272, 273/34, 414 of the Indian Penal Code and Section 30(A)(C) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of 74.535 litres of foreign wine were made from the car in which the petitioner was travelling and not from his conscious possession. The petitioner is not having any criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal
