2. The petitioner apprehends his arrest in connection with Cyber P.S. Case No. 24 of 2025, registered for the offences punishable under Sections 79, 356(2) 351(4) of the BNS, 2023 and Sections 66(C), 66(D), 67(B) of the I.T. Act.
3. Based upon the written report, the prosecution alleges that co-accused Subhash Kumar by creating a Facebook I.D. of Veena Chauhan has uploaded indecent and vulgar photographs of her daughter and made it viral. It is further alleged that the friends of Subhash Kumar including the petitioner were also involved in writing obscene comments and making photographs of the minor daughter of the informant viral. On 20.03.2025, while the daughter of the informant was going to school, the accused persons also caught hold her hand

Learned Advocate for the petitioner submitted that the entire allegation revolves around co-accused Subhash Kumar and only on account of he being the suspected friend of co-accused, his name has been implicated in this case. On the date on which the alleged occurrence took place i.e., 20.03.2025 the petitioner was at Pune and in fact he has nothing to do with the present crime. Taking this Court through the FIR, learned Advocate for the petitioner submitted that there are altogether three IDs. in the name of Deepak Kumar and none of them belongs to him. He further contended that besides the petitioner having fair antecedent, he undertakes that he will fully cooperate in the investigation and the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that serious allegation has been levelled against all the accused persons of defaming and torturing the girl by making her obscene photographs viral.
6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the fair antecedent and the lack of material which clearly speaks about the involvement of the petitioner in the

No.61402 of 2025(2) dt.10-09-2025 3/3 crime, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Muzaffarpur, East in connection with Cyber P.S. Case No. 24 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further conditions: (i) that one of the bailors shall be the own/close family members of the petitioner, and (ii) that in future if the petitioner would be found involved in any activity or indulge in intimidating the victim/witnesses or tampering with the evidence, the informant shall be at liberty to file an application for cancellation of the bail of the petitioner.
