The petitioner is apprehending his arrest in connection with Madanpur P.S.Case No.98 of 2019 registered for offences punishable under Sections 302, 394, 397 and 34 of the Indian Penal Code.

As per FIR, while the informant was coming, come miscreants intercepted him and looted away his ornaments and also fired on him causing injury to him. It is also alleged that when brother of the informant chased him, he was also shot at, causing injury to him and later on he succumbed to the injuries. Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is nothing against him, no recovery .

On the other hand the learned APP has opposed the prayer

Patna High Court CR. MISC. No.62231 of 2019(3) dt.21-11-2019 2/2 for bail on the ground that FIR shows that the case is of heinous offence.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I do not find to be a cae of anticipatory bail as such the the petitioner is directed to surrender before the learned court below and make prayer for regular bail.

With the aforesaid direction, this application is dismissed.
