This application for grant of regular bail arises out of Matihani P.S. Case No.74 of 2023 registered for the offence punishable under Sections 120-B, 324, 326 & 302/34 of the Indian Penal Code.

The petitioner is said to have taken the deceased along with him. After some time, the dead body of the deceased was recovered.

The submission of learned counsel for the petitioner is that it is a case of last seen and as per the evidence collected during investigation, it has come that other accused persons have killed the deceased.

Patna High Court CR. MISC. No.64288 of 2023(2) dt.11-10-2023 2/2 counsel for the petitioner. It is the petitioner who had called the deceased and thereafter the dead body of the deceased was found.

Considering the aforesaid facts, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this application is accordingly rejected. The petitioner may renew his prayer for bail if there is no sufficient progress in the trial.
