The petitioners seek bail in connection with Rahui P.S. Case No. 198 of 2021 instituted for the offence under Section 392 of the Indian Penal Code.

The informant alleged that on 23-04-2021, while going to his village, four miscreants stopped his motorcycle. They snatched his motorcycle and also took Rs.1,000/- cash and his mobile phone.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 31-05-2024. Petitioners bear five criminal antecedents, as per disclosure made in
Patna High Court CR. MISC. No.61419 of 2025(2) dt.04-09-2025 2/3 paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. Petitioners are not named in the FIR. Names of the petitioners have transpired on the basis of confessional statement of co-accused, namely, Manish Kumar and he has been enlarged on anticipatory bail by the court below itself. Nothing has been recovered from the conscious possession of the petitioner. Petitioners have no concern with the alleged occurrence. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioners, manner of petitioner's implication and charge-sheet being submitted, this Court is inclined to grant bail to the petitioners. 8.
Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteeen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Rahui P.S. Case No. 198 of 2021, subject to the following conditions:
Patna High Court CR. MISC. No.61419 of 2025(2) dt.04-09-2025 3/3 (I) One of the bailors shall be own/close member of the family of the petitioners.
(II) The petitioners shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioners.
