The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 399, 402, 413, 467, 468, 471, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26/35 of Arms Act.

It is a case of recovery of 2 live cartridges from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has

The petitioner has not committed any offence and only on the basis of suspicion, he has falsely been implicated in this case. Moreover, petitioner is languishing in judicial custody since 17.05.2022. It is further submitted that similarly situated co-accused persons have been granted Bail vide order dated 10.01.2023 and 7.2.2023 passed in Cr. Misc. No. 47869 of 2022 & Cr. Misc. No. 60120 of 2022 respectively, passed by this Court.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bochahan P.S. Case No. 213 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction
