JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2017 The petitioners seek regular bail in connection with Minapur P.S. Case No. 100 of 2016, registered for offences punishable under Sections 302/34 Indian Penal Code. It has been submitted on behalf of the petitioners that only general and omnibus allegations have been levelled against these petitioners, who happens to be brother-in-law and sister-inlaw of the deceased and other co-accused, who is also brother-inlaw of the deceased has already been granted the privilege of bail by this Court vide order dated 15.02.2017, passed in Criminal Miscellaneous No. 48576 of 2016 and the petitioners are in custody since 28.01.2017, which he has stated on oath in
Patna High Court Cr.Misc. No.13955 of 2017 (2) dt.27-03-2017 2/3 paragraph 12 of the bail petition.
Learned counsel for the State also could not controvert the above submission of learned counsel for the petitioner. Having heard both sides, considering the facts and circumstances of the case, period of custody and also other coaccused having similar allegation has already been granted bail by this Court, as such, let petitioners, above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Minapur P.S. Case No. 100 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) Petitioners shall not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court
Patna High Court Cr.Misc. No.13955 of 2017 (2) dt.27-03-2017 3/3 and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
