The petitioner apprehends his arrest in a case under Section 304 of the Indian Penal Code.
The informant alleged that drainage was being constructed under the scheme of Chief Minister Urban Development Scheme. Earth was dug but there was no progress in the construction of drainage. The daughter of the informant drown in the water logging in drainage.
It is submitted that petitioner is a contractor. There was no negligence on the part of the petitioner. The petitioner was not event present there and he was doing the work of contract under the scheme according to payment made by the Government. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in Supaul P.S. Case No. 28 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
