The petitioners seek regular bail in connection with Sessions Trial No. 180 of 2018 arising out of Lakhisarai P.S. Case No. 14 of 2018, registered for the offence punishable under Sections 302/34, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioners are of indiscriminate firing on the husband of the informant and he died and petitioners are accused in several cases including case for offence under Section 302 of the I.P.C.

It has been submitted that the petitioners are co-sharer of the informant, there is land dispute and a Title Suit No. 63 of

Patna High Court CR. MISC. No. 60369 of 2019(4) dt.06-02-2020 2/2 2005 is pending between the parties. The informant is not eye witness of the occurrence.

Heard learned APP and learned counsel for the informant who has opposed the prayer for bail and submitted that the trial is going on and the informant was already examined who has supported the prosecution case. Earlier the petitioners threatened the deceased to kill him.

Considering the aforesaid facts, I am not inclined to enlarge the petitioners on bail. The trial court is directed to expedite the trial and conduct it on regular basis and so that the trial may be concluded within a period of nine months. At the same time, prosecution as well as informant of the case and the accused persons are directed to cooperate in disposal of the trial. This application is accordingly dismissed.
