The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 127 of 2016, registered under Sections 302 and 120-B of the Indian Penal Code and Section 27 of the Arms Act.

The allegation of informant, namely, Kumar Markandya Singh is that on 09.06.2016 at about 9.00 P.M. he was returning his house from Mangri Chowk, then heard the sound of firing near the house of Pappu Keshri then he saw that Mritunjay Singh was caught hold by Mukesh Kumar @ Guddu, Chunnu Mahto and Basu Kumar along with two unknown were also present there. At that time, on the order of Mukesh Kumar,

Patna High Court Cr.Misc. No.15033 of 2017 (2) dt.13-04-2017 2/2 Chunnu Mahto and Basu Kumar shot fire at Mritunjay Singh, who was rushed for treatment for Sadar Hospital, where Doctor declared him dead.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that informant is eye-witness of the occurrence, but he has not disclosed the name of the petitioner. In course of investigation it has only come that he talked to Chunu Mahto, who is said to shot fire at deceased before the occurrence on mobile. Further submission is that while petitioner is accused in six other cases, but he is on bail in that cases and in the present case, he is in custody since 11.01.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 127 of 2016.
