The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code, Section 4/5 of the Explosive Substances Act, Section 15 (A)(II)(III)/16(A) of the U.P.P.A. and M.C. Rule 4/21 of M.M.C. and D.F.
The informant, police officer, got information that the petitioner had kept explosives in a hut by the side of Maika mines and on such a raid was conducted. Huge quantity of Ziletin and explosives were recovered from the hut.
It is submitted that the petitioner was not apprehended on the spot and nothing has been recovered from the conscious possession of the petitioner. The petitioner is not the owner of the
Patna High Court Cr.Misc. No.43557 of 2015 (3) dt.23-11-2015 2/2 hut.
Having considered the facts aforesaid and the fact that the petitioner is alleged to have kept explosive substances in a hut from where the same were recovered and he has got criminal antecedent, I am not inclined to enlarge the petitioner above named on anticipatory bail.
