The petitioner seeks bail in a case registered for the offences punishable under sections 420 and 376 of the Indian Penal Code.

The prosecutrix made allegation that she was married but her husband was suffering from genetic illness. She got divorce. Petitioner is friend of her brother and he used to come to her house. Petitioner persuaded her to marry and on the pretext of marriage, petitioner established physical relation. It appears on the face of allegation that the prosecutrix was a major lady and she was a consenting party in establishing physical relation with the petitioner.

Patna High Court Cr.Misc. No.43057 of 2015 (2) dt.17-09-2015 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Mishra Judicial Magistrate, 1st Class, Gopalganj in connection with Bhorey P.S. Case No. 101 of 2015.
