Heard the parties.

The petitioner is apprehending his arrest in connection with Panapur P.S.Case No.101 of 2013 registered for offences punishable under Sections 47(a) of the Excise Act. It is submitted on behalf of the petitioner that earlier the petitioner had moved for anticipatory bail, which was rejected by the Sessions Judge in the year, 2014 and thereafter, he was granted police bail since 28.03.2015 but now the charge-sheet has been submitted and the petitioner has moved for anticipatory bail. It is also submitted that the co-accused has been granted anticipatory bail by this Court, vide order dated 03.03.2015 passed in Cr. Misc.

Patna High Court Cr.Misc. No.14826 of 2017 (2) dt.03-04-2017 2/2 No.7577 of 2015.

Heard learned A.P.P. also.

Having head both sides and considering the fact that the case is of the year, 2013, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below and considering all aspects of the matter i.e. materials against the petitioner as well as other coaccused persons, who has been granted bail, the learned court below will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
