ANJANA MISHRA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

Earlier notice was issued to opposite party no. 2 but opposite party no. 2 has not chosen to appear before this court. The petitioner apprehends his arrest in connection with Goraul P.S. Case No. 116 of 2010 for the offences registered under Sections 341, 323, 494, 498(A) of the Indian Penal Code and Section 3(x) of the SC/ST (Prevention of Atrocities) Act. Learned counsel for the petitioner submits that opposite party no. 2 and 2(a) are one and the same person, who happens to be the wife of Rameshwar Paswan and not the petitioner.

No.47864 of 2014 (6) dt.09-05-2016 In view of the fact that the petitioner has denied the marriage with the opposite party no. 2, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 116 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
