The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 447, 420, 504, 506 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the informant entered into an development agreement with regard to a land with a Developer Chandrashekhar Prasad but subsequently the
Patna High Court Cr.Misc. No.42971 of 2015 (2) dt.16-10-2015 2/3 land was got fraudulently transferred. It is alleged that Chandrashekhar Prasad, Binod Choudhary and this petitioner came to the house of the informant, abused by calling caste name and started getting soil filled of the land of the informant. It is submitted by learned counsel for the petitioner that with regard to dispute between the petitioner and the Developer Chandrashekhar Prasad the accusation has been levelled. For the occurrence of 09.05.2015 at 11.00 A.M. the FIR was registered on 10.05.2015 at 2.30 P.M. which reached to the court of learned S.D.J.M. on 12.05.2015.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation in the background of dispute with regard to development agreement and transfer of land, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Danapur, Patna in connection with Khagaul P.S.
