ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.07.2019 in connection with Alamganj P.S. Case No. 521 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were made from the road in front of Dank Imli Electric Office, Almganj and not from his conscious possession. It is further submitted that the petitioner is a man of clean antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)

Patna High Court CR. MISC. No.58614 of 2019(2) dt.27-09-2019 2/2 with two sureties of the like amount each to the satisfaction of the court of learned Additional District Judge II-cum- Special Judge, Excise, Patna in connection with Almganj P.S. Case No. 521 of 2019.
