2. Let the defect(s), if any, be removed within a period of four weeks from today.

3. The petitioner seeks bail in connection with Pusa P.S. Case No. 60 of 2023 registered for the offence under Sections 341, 342, 323, 504, 506 and 307 of the Indian Penal Code read with Section 27 of the Arms Act.

4. As per the prosecution case the petitioner along with others co-accused is involved in causing two gun shot injuries upon the victim.

5. Learned counsel for the petitioner submits that the petitioner is a disabled person and he has falsely been implicated in this case.

6. Learned counsel for the petitioner further submits

Patna High Court CR. MISC. No.66257 of 2023(2) dt.16-10-2023 2/2 that there is no specific allegation against the petitioner of firing upon the victim and he also offers to pay Rs. 25,000/- for the treatment of the victim.

7. Learned counsel for the petitioner also submits that the petitioner is in custody since 20.06.2023.

8. Learned A.P.P. has vehemently opposed the prayer for bail.

9. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

10. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur in connection with Pusa P.S. Case No. 60 of 2023.

11. As a condition of this order, the bail bond of the petitioner shall be accepted by the Court below only after he brings a Demand Draft of Rs. 25,000/- in the name of the victim and the same shall be released in favour of the victim by the Court below.
