JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mahila P.S. Case No. 62 of 2016 instituted for the offence under Sections 376, 420 and 34 of the Indian Penal Code.

There is allegation against the petitioner in the written report that he on the pretext of marrying with the informant, established relationship with her and when she told him to marry her, the petitioner always avoided. The informant told about the incident to her family members. He went to the house of the petitioner but he was abused by petitioner and his family members and they refused to marry the petitioner with informant. As such there is direct allegation against the petitioner of establishing physical relationship with the informant

Patna High Court Cr.Misc. No.14575 of 2017 (2) dt.30-03-2017 2/2 on the pretext of marrying her. Therefore, this Court does not find it a fit case for grant of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender before the court below and make prayer for regular bail.
