This application for anticipatory bail arises out of Dagarua P.S. Case No. 113 of 2020 registered for the offence punishable under Sections 342, 147, 148, 149, 120-B and 302 of the Indian Penal Code.

The deceased was taken away by the accused persons and such scene has been witnessed by the informant, who was also assaulted by the accused persons. When there is direct evidence available against the petitioner of having taken away the deceased and thereafter the deceased was found dead, in the opinion of this Court, this is not

Patna High Court CR. MISC. No.726 of 2022(2) dt.22-03-2022 2/2 a fit case for grant of anticipatory bail to the petitioner though it has been argued by learned counsel for the petitioner that similarly situated accused persons have been granted anticipatory bail.

Accordingly, this anticipatory bail application is dismissed.
