The petitioner is languishing in custody since 26.02.2014 in a case registered for the offences punishable under Sections 25(1-B)a/26/35 and 27 of the Arms Act. It is alleged that sophisticated arms and ammunitions were recovered from the Jai crop field and the petitioner and others were seen fleeing away from the place of occurrence.

It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner and only on suspicion the accusation has been levelled,

No.42953 of 2014 (03) dt.04-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, District - Patna in connection with Barh P.S. Case No. 39 of 2013.

Considering the serious criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
