JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 06-10-2015 Petitioner is a Constable, who has been compelled to approach the High Court because he is not being paid his salary since January 2015.

The short facts are that on a command issued in favour of the petitioner at the level of the Superintendent of Police, East Champaran at Motihari, he proceeded to PMCH for treatment. After obtaining the treatment, he returned and reported in the police station on 14.1.2015. Another command was issued on 17.1.2015 directing the petitioner to join at Dhaka police station. Petitioner joined the said police station and has been working but he is not getting salary. From the facts narrated in the writ application, if they

Patna High Court CWJC No.14507 of 2015 dt.06-10-2015 2/2 are correct, then it is an unacceptable position because a low paid employee cannot do without salary for such a long period of time. No counter affidavit has been filed in the writ application as yet. Instead of awaiting for a counter affidavit to be filed at the level of the S.P., Motihari, the Court would direct the S.P. to look into the matter and pass an appropriate direction with regard to payment of salary of the petitioner unless there is some legal impediment in his way.

A decision in this regard ought to be taken preferably by 31st October, 2015.
