JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-10-2015 Petitioners apprehend their arrest in Panapur Police station Case No. 48 of 2015 dated 24.5.2015 instituted under section 366A of Indian Penal Code on the allegation that petitioner no.1 abducted his minor daughter, who on recovery made statement stating that petitioner no.1 took her away on motorcycle and also misbehaved her.

Learned counsel for the petitioners submit that from the FIR and the statement of the girl it appears that there is allegation against petitioner no.1 alone. He further submits that petitioner no.1 is minor, whereas petitioner no.2 and 3 are his father and uncle.

In the facts of the case, in case of surrender within six weeks, let petitioners no.2 and 3, named above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of

Patna High Court Cr.Misc. No.43740 of 2015 (2) dt.13-10-2015 2/2 the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Panapur Police station Case No. 48/2015.

As petitioner no.1 has claimed to be a minor and already learned Sessions Judge, Saran has directed to appear him before the Juvenile Justice Board, Saran to seek regular bail. The petitioner should appear before the Board and make an application for bail.
