Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Chapra Town P.S. Case No. 11 of 2019 registered under Sections 188, 120(B)/34 of the Indian Penal Code read with Sections 30(a)/38/41 of the Bihar Excise and Prohibition Act. Learned counsel for the petitioner submits that the petitioner is in custody since 12.11.2021, charge-sheet has been submitted and has antecedent of ten cases and allegation is of recovery of 2682.36 litres of foreign liquor from a Truck. Learned counsel for the petitioner submits that the petitioner was not arrested at the spot, his name came in the
Patna High Court CR. MISC. No.520 of 2022(2) dt.02-03-2022 2/2 confessional statement of the co-accused at the behest of police, based on his antecedents.
Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted and was not arrested at the spot and his name came on the basis of confessional statement of coaccused, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Chapra in connection with Chapra Town P.S.
