The petitioner apprehends his arrest in Town P.S. Case No.178 of 2018, registered under Sections 448, 341, 323, 379, 427, 498A and 34 of the Indian Penal Code.

The informant alleged that at about 9.00 in the night on 22.05.2018 her husband Dr. Vivek Mallick, Abhishek Mallick, Renu Mallick, Ratikant Mallick and 5-6 other persons came and snatched her seven months' child from her lap. On protest, the accused persons assaulted the informant and her family members.

Learned counsel for the petitioner submits that the petitioner is the brother-in-law of the informant. No specific allegation is made against the petitioner. The husband and the

Patna High Court CR. MISC. No.58010 of 2019(2) dt.18-09-2019 2/2 wife are quarreling with each other and that is why the wife implicated her husband and all other family members. Petitioner has got no manner of concern with the affairs of the husband and wife.

Taking into consideration the facts and nature of allegation made against the petitioner and the fact that the petitioner is the brother-in-law of the informant, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Town P.S. Case No.178 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
