====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sakra P.S. Case No. 82 of 2020 registered under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the informant alleges that he was intercepted by six unknown criminals who looted his motorcycle, mobile and cash worth Rs. 65,000/-, further alleges that he identified Jhunjhun, Bambam and Viccky Jha but was not able to identify the other three accused persons. Learned counsel submits that name of this petitioner transpired in the confessional statement of Md. Firoz who has been granted bail by order dated 27.01.2021 in

Patna High Court CR. MISC. No.236 of 2022(2) dt.16-05-2022 2/2 Criminal Misc. No. 33811 of 2020, as such, it is submitted that the person in whose confession the name of the petitioner transpired has been granted bail, therefore, petitioner deserves to be enlarged on bail.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.09.2021, is a person with clean antecedent and chargesheet has been submitted in the case and name transpired in the confessional statement of co-accused, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sakra P.S. Case No. 82 of 2020.
