The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 139 of 2016, registered for the offence punishable under Section 304 of the Indian Penal Code. Allegedly, the petitioner had surrounded the pond with bamboo stick and open wire having electric current resulting, the husband of the informant got electric shock and died. Submission is of false implication and that the informant has received compensation from Muzaffarpur Vidyut Vitran Limited which goes to reveal that the petitioner was not involved in any way in that incident, he has been made victim of the circumstances. The informant has filed petition in this case

Patna High Court Cr.Misc. No.14326 of 2017 (2) dt.11-05-2017 2/2 before the learned Court below that the electric wire fell on the body of her husband when he was cutting grass and the police obtained her thumb impression on blank paper. The petitioner is innocent and he has been falsely implicated in this case and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. after going through Annexure- 2 and 3, fairly submits that the informant has received compensation amount from Muzaffarpur Vidyut Vitran Limited for that incident and further she has filed petition showing innocence of the petitioner vide Annexure-3.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-10-cum-A.C.J.M., Muzaffarpur, arising out of Hathauri P.S. Case No. 139 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
