Earlier vide order dated 15.12.2014, this Court after considering the bail matter had called for the carbon copy of the case diary and had also directed that no coercive steps be taken against the petitioner in connection with the present case. The diary in the present case has since been received. Learned counsel for the petitioner submits that during the course of investigation, it has surfaced that the petitioner had no role to play whatsoever. In fact, he has not been sent up trial. Learned counsel for the State has pointed to paragraph Nos. 49 and 50 of the case diary wherein it has been categorically found that it was in fact the father of the victim girl Baby Kumari, who had struck the deceased as a result of which, he succumbed to his

Patna High Court Cr.Misc. No.43807 of 2014 (3) dt.16-04-2015 P2/2 injuries.

Considering the available materials in the case diary and also the submission by learned counsel for the petitioner that the petitioner has got clean antecedent, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Adhoc Additional Sessions Judge, IVth, Munger in connection with Dharhara P.S. Case No. 85/2009 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J.) Saif/- U T
