JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-09-2015 The petitioner is a Cold storage and is having an electrical connection under H.T.S. Category having a contract demand of 84 KVA. The electric connection of the petitioner has been disconnected in view of meter testing report that the meter was tempered.

The petitioner submits that it is willing to pay 50% of the bill raised in two equal monthly installments within two months. In this view of the matter, on deposit of first equal monthly installment, the electric line of the petitioner will be restored which would be subject to deposit of second installment.

As the petitioner has already filed an objection under section 126(3) of the Electricity Act seeking some details, the Assessing Officer would respond to the aforesaid request. It goes without saying that it would be open for the petitioner to take all such objections to put in its defence. With the aforesaid observations and directions, this writ application stands disposed of.
