The petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 128 of 2015 registered under Sections 393 and 398 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation his name has come in the confessional statement of co-accused, Mukesh Yadav and on that confessional statement petitioner has been remanded in the present case along with two other cases as detailed in paragraph 3 of the petition except that there is nothing against the petitioner.

No.43441 of 2015 (2) dt.14-10-2015 Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Motihari Town P.S. Case No. 128 of 2015/ G.R. No. 815 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
