Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioners is of commission of assault. The allegation of commission of firearm injury and death is against co-accused, Suresh Yadav.

Learned counsel for the informant opposed the prayer for bail. However he has got no injury report, nor the injury report is available with the case diary available with him.

No.58136 of 2019(2) dt.19-09-2019 2/2 Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bhabua Police Station Case No.329 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
