2. The petitioner seeks regular bail in a case registered for the offence under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, the police, on confidential information, have recovered 15 liters of illicit liquor and it is alleged that several persons after consuming illicit liquor fell ill and one out of them has died. Petitioner is in jail since 24.11.2022.

4. Considering the facts and circumstances of the case, this application for regular bail is allowed.

5. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)

No.79646 of 2023(3) dt.05-03-2024 2/2 with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-1st, Nawada/concerned Court below in connection with Nawada Town P.S. Case No. 384 of 2021 subject to condition that:- 5(i). The petitioner will mark his attendance at the Beltharia Police Station/local police station, West Bengal on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

5(ii). The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.

6. This application stands allowed.
