The petitioner seeks bail in a case under Section 395 of the Indian Penal Code and under section 3⁄4 of Explosive Substance Act.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The name of the petitioner figured in the case in the confessional statement of co-accused and the petitioner is also said to have confessed his guilt. Later on, as appears from the order of learned Additional Sessions Judge, two persons named the petitioner but that too after many days of the occurrence. The petitioner has not been put on T. I. parade.

Considering the facts aforesaid and the nature of

No.44855 of 2015 (2) dt.24-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Pupari at Sitamarhi in Nanpur P.S.
