2. The petitioner is in custody since 13.08.2023 in connection with Gopalpur P.S. Case No. 197/2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 528.600 litres of countrymade liquor has been recovered from the Scorpio vehicle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner has no concern with the alleged recovery of liquor and he was merely a passenger who has taken lift from the driver of the alleged vehicle.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.64459 of 2023(2) dt.11-10-2023 2/2 behalf of the State has vehemently opposed the prayer for bail.

6. In view of the aforementioned facts and circumstances and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IV-cum-Exclusive Special Excise Court No. II, Gopalganj, in connection with Gopalpur P.S. Case No. 197/2023.

7. The petitioner is directed to mark his attendance before the Chakagaon Police Station on the first Sunday of every month.
