NILU AGRAWAL ORAL ORDER 13-03-2019 Heard learned counsel for the petitioner, learned counsel for the State, learned counsel for the Tilka Manjhi University, Bhagalpur (hereinafter referred to as the University) and learned counsel appearing on behalf of Respondent No. 7.

2. By order dated 13.12.2018, the matter was sent to the mediation cell of the Patna High Court for both the petitioner and Respondent No. 7 to appear for an amicable settlement.

3. The Mediator has submitted report dated 21.02.2019, which is at Flag-A, stating therein that on mediation the dispute has been settled. The petitioner would get 40% of the retiral benefits and arrears of salary of the late employee Ram Singh @ Ram Sharma, who died as Class-IV employee of the University on 02.07.2017 while Respondent No. 7 Nilam Devi would receive family pension and 60% of the retiral benefits and arrears of salary. The matter of compassionate appointment of the son of the petitioner is under active consideration by the University.

4. Considering the fact that the dispute has been settled in mediation, the University is directed to take appropriate steps as per the terms of settlement arrived between the parties within a period of two months from the date of receipt/production of a copy of this order before the authorities of the University.
