The petitioners apprehend their arrest in Mahishi P.S. Case No. 94/2015, registered for the offences punishable under Section 307, 323 and other sections of the Indian Penal Code. The informant Surya Narain Yadav alleged that all the accused persons came and assaulted the informant and when Phuleshwar Yadav and Chandradev Kumar came, accused persons also assaulted them.
It is submitted that there is counter version. From the
Patna High Court Cr.Misc. No.44555 of 2015 (3) dt.18-12-2015 2/2 side of the petitioner six persons are injured. The informant Surya Narain Yadav and Chandradev Kumar got simple injuries. Phuleshwar Yadav got two grievous injuries on account of fracture of bones on hand and ribs, but it was not disclosed as to who assaulted Phuleshwar Yadav causing fracture injury. Considering the facts that from both sides there is mutual fighting and on account of blowing of loudspeaker both sides have sustained injuries, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saharsa in connection with Mahishi P.S. Case No. 94/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
