Petitioners are languishing in custody for the offences punishable under Sections 325/326 /307 /427/ 302 / 364 /504/506 and other minor sections of the Indian Penal Code. There is general and omnibus allegation against the petitioners and others to have assaulted Rakesh Kumar, who succumbed during the course of treatment.

Submission of the petitioner is that the allegation is general and omnibus. There is no eyewitness of the occurrence. Considering the aforesaid facts, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at
