2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 342, 323, 307 and 34 of the Indian Penal Code.
3. As per allegation in the FIR, while the informant was going for natures call, petitioner and accused Ranjan Yadav forced him to take wine. On his denial, they assaulted him by means of knife as a result of which he sustained several injuries.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Injury received by the injured/informant is simple in nature. There is case and counter case. Charge has been framed against the petitioner and there is no chance of tampering with the
Patna High Court CR. MISC. No.75347 of 2023(2) dt.29-11-2023 2/2 prosecution evidence. Petitioner is languishing in judicial custody since 8.2.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st Rohtas at Sasaram in connection with S.Tr. No. 547 of 2023 arising out of Bikramganj PS Case No. 54 of 2023.
