JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-11-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Earlier the anticipatory bail of the petitioner was allowed vide order dated 20.04.2022 passed in Cr. Misc. No. 56461 of 2021 with a condition that he shall pay Rs.

Patna High Court CR. MISC. No.66681 of 2023(3) dt.10-11-2023 2/3 10,000/- per month a maintenance to the complainant. It is submitted by learned counsel for the petitioner that petitioner is a poor person and not able to pay Rs. 10,000/- as maintenance to the complainant. Hence, he surrendered before learned Court below. The petitioner is still ready to keep the complainant as wife with full dignity and honour. The petitioner is not having criminal antecedent and he is languishing in custody since 06.01.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate (East), Muzaffarpur in connection with Complaint Case No. 2520 of 2016, Trial No.
