The petitioner seeks bail in connection with Dhol Bajja (Kadwa) P.S. Case No. 32 of 2016, registered under Section 302/34 of the Indian Penal Code.
The accusation is that informant, on receiving information about the death of his son, Pankaj Kuamr, reached the village and saw the dead body of his son in the courtyard of Shambhu Mandal. The informant raised suspicion against the petitioner and four others having hand in the murder of his son by administering poison.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that informant is not the eye witness
Patna High Court Cr.Misc. No.15075 of 2017 (2) dt.20-04-2017 to the occurrence regarding the murder of his son, Pankaj Kumar. Further submission is that, in course of investigation, only it has come that there was illicit relation between the petitioner and the deceased and deceased was giving pressure upon the petitioner for marriage but she refused, thereafter son of the informant consumed poison. Further submission is that petitioner is in custody since 13.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia, in connection with Dhol Bajja (Kadwa) P.S. Case No. 32 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
