2. Petitioner apprehend arrest in a case registered for the offences punishable under Sections 363, 366(A), 120(B)/34 of Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
3. It is alleged that this petitioner along with other F.I.R. named accused persons kidnapped the daughter of the informant for the purpose of marriage.
4. Learned counsel appearing for the petitioner submits that victim in her statement, recorded under Section 164 of Cr.P.C., has denied the allegation against the petitioner and has categorically stated that she left her house and went to Kotwa by bus and called this petitioner and from their they went
Patna High Court CR. MISC. No.63902 of 2023(2) dt.16-10-2023 2/2 to Rajasthan and solemnized marriage. Petitioner claims clean antecedent.
5. Considering the statement of the victim recorded under Section 164 of Cr.P.C., this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judgecum-Special Judge POCSO Act, Motihari, East Champaran in connection with Pipra P. S. Case No. 207 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
