The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Informant alleges that on account of dispute relating to cricket match, more than 30 persons assembled and a free fight took place. Further, it is alleged that the petitioner fired over Santosh Pandey due to which he has sustained injury.
Learned counsel for the petitioner submits that the petitioner is in custody since 02.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that in the FIR it has been alleged that a free fight took place,

No.2098 of 2022(2) dt.24-05-2022 2/2 where people from both side came on account of dispute relating to a cricket match and it is just not possible for informant to witness the occurrence with such precision, further submits that the fire arm injury received by Santosh Dubey, is simple in nature. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and taking into consideration the injury caused to Santosh Dubey is simple in nature, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sheosagar P.S. Case No. 241 of 2020 subject to the condition that if the learned court below comes to a conclusion that after release the petitioner is trying to delay the trial of the case, the court below shall forthwith cancel his bail bond after recording reasons.
