JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 05-11-2018 From the order dated 4.10.2018 it appears that direction was issued to the State to file counter affidavit on the point whether the petitioners have been paid remuneration for the period they have worked.
Learned counsel appearing on behalf of the respondents would submit that cheque was available for payment but no one has turned up to receive the payment. The cheque was valid for three months and that has expired and payment has not been made.
Patna High Court CWJC No.13103 of 2013 dt.05-11-2018 2/2 It was not on account of fault on the part of the authorities of the Education Department but on account of failure on the part of the petitioner.
Since no one had appeared on previous occasion and even today despite the case has been listed "For Dismissal", no one is present to assist the Court.
Accordingly, the writ petition is disposed of with liberty to the petitioner to approach the authorities along with a copy of this order. The District Education Officer, Saksharta shall ensure payment of unpaid remuneration within 15 days from the date of filing of such representation.
