13-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 30.09.2016, in connection with Banka P.S. Case No.140/2016 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. It has been submitted by the learned counsel for the petitioner that he is the father-in-law of the deceased and husband is already in custody. It is further submitted that there is general and omnibus allegation against the petitioner and charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State opposes the prayer for bail.

No.15429 of 2017 (2) dt.13-04-2017 Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No.140/2016.
