The petitioner is aggrieved by and dissatisfied with the order dated 04.05.2018 passed by learned Principal Judge, Family Court, Katihar in Maintenance Case No. 95 of 2017 whereby and whereunder the learned Principal Judge, Family Court, Katihar has allowed the interim maintenance allowance of Rs. 5,000/- per month to opposite party.

It appears that the petitioner has moved this Court against the impugned order which is an interim order passed under Section 125 Cr.P.C. In the light of the judgment of the Hon'ble Division Bench of this Court in the case of Md. Akil Ahmad versus State of Bihar and Anr. reported in 2016(4)

Patna High Court CR. REV. No.780 of 2018(4) dt.06-07-2022 2/2 PLJR 968, this revision application is not maintainable against an interim order.

This application is, thus, dismissed for both the reasons as stated above but with liberty to the petitioner to seek his remedy, if so advised in appropriate jurisdiction. Mr. Bimal Kumar, learned counsel for the opposite party is present.
