JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 120(B) of the Indian Penal Code and Sections 47(A), 51, 57, 63 of Bihar Excise (Amendment) Act, 2016.

The police intercepted a truck and in huge quantity bottles of Indian made foreign liquor were recovered from the aforesaid truck. The driver of the aforesaid truck was arrested and disclosed that the owner of the aforesaid truck had asked him to unload the aforesaid seized liquor at a poultry farm. The police raided the aforesaid poultry farm and arrested two persons, namely, Ainul Ansari and Saddam Husain. The aforesaid arrested

Patna High Court Cr.Misc. No.39185 of 2016 (3) dt.26-09-2016 2/2 persons disclosed the name of petitioner and others. Admittedly, nothing was recovered from conscious possession of the petitioner nor petitioner does have any criminal antecedent. Moreover, having similar allegation, co-accused, Rohit Kumar @ Jackie has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of S.J. 1st cum ACJM, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 121 of 2016.
