The petitioner apprehends his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Allegation is of looting the informant by three unknown accused.

Learned counsel for the petitioner submits that the petitioner has antecedent of two cases, he is not named in the F.I.R. and his name came in the confessional statement of accused Raunak who was also arrested during the course of investigation, it is next submitted that Raunak has been granted bail by the learned District Court itself, thus it is submitted that when the accused, on whose confession the name of the

Patna High Court CR. MISC. No.667 of 2022(2) dt.04-08-2022 2/2 petitioner transpired, has been granted bail by the learned District Court then the case of the petitioner for grant of anticipatory bail be also considered.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that since Raunak who was also not named in the F.I.R., was apprehended in course of investigation and his name also transpired on confession, has been granted bail by the learned Trial Court, the petitioner on parity should also move the learned trial court. At this stage, the learned counsel for the petitioner seeks permission to withdraw the present application. Permission is accorded.

In the event, if the petitioner surrenders on or before 25.08.2022, the learned trial court shall pass orders in accordance with law keeping the above observations in mind. This application is accordingly disposed of.
